Section 1. Owner, Guardian, and Female Dog

1.4 Breeder retains legal ownership of the dog.
1.5 Breeder retains ownership of all puppies produced by the Dog.
1.6 Ownership of the Dog will be transferred to Guardian when Breeder stops using the Dog for Breeding. This is typically 4 to 6 successful litters.
1.7 A successful litter is defined as a litter of at least 4 puppies that live to 8 weeks old.
1.8 After all successful litters are complete and ownership has been transferred to the Guardian, the Guardian agrees to spay the dog within 6 months or before the next heat, whichever comes first. All costs associated with spaying the dog are at the Guardian’s expense.
Section 2. Breeder
2.1 Breeder is guaranteed to visit the Guardian home at least twice per year.
2.2 Breeder will pay all cost related to genetic testing and breeding for the Dog.
2.3 Breeder will house the Dog during breeding time and return to Guardian when breeding is complete. Typically, this is a period of 4 to 7 days.
2.4 Typically it is expected that the Dog will be bred on her second heat and every heat thereafter according to her health up to the agreed litter amount.
2.5 Breeder has the right to confiscate and rehome the Dog if the Guardian fails to fulfill any portion of the agreement.
Section 3. Guardian
3.1 Guardian agrees to feed the Dog Exclusive Signature brand dog food while in the guardian program. Exclusive Signature is a high-quality food that will ensure the health of the Dog and her Puppies.
3.2 Guardian is obligated to diligently watch for each new heat cycle and to notify Breeder immediately when the Dog has come into heat.
3.3 Guardian understands and agrees that the Dog will not be relocated out of the State of Utah until the Dog has completed the required litters and ownership has been transferred to Guardian.
3.4 Guardian must assist Breeder to ensure that the Dog is available to breed at the appropriate time.
3.5 Guardian must notify Breeder of any change in address, telephone number, or email address.
3.6 Guardian is responsible for all normal immunizations, vet visits, and normal sick dog veterinary fees.
3.7 Guardian will not choose or allow any elective veterinary procedures without the consent and without consulting with Breeder.
3.8 If the Dog becomes pregnant, from an unauthorized sire, while in the Guardian’s care, through negligence, Guardian may be held liable for damages caused to Breeder’s/Owner’s business.
Section 4. Damage to Guardian’s property and/or bodily injury
4.1 Guardian acknowledges and accepts that they are solely responsible to Potty Train the dog for their home and their own personal environment. No guarantee is given or implied in any manner that the puppy will not have accidents in the Guardian’s home.
4.2 Guardian acknowledges and accepts that they are solely responsible to provide crate training in their home, if they choose.
4.3 Guardian acknowledges and accepts the risk of possible damage by bringing an animal into the home and holds the Breeder/Owner blameless for any and all such damage.
4.4 Guardian acknowledges and accepts that the Guardian is solely responsible for any possible damage caused by the dog and that the Breeder/Owner is not responsible for any damage to Guardian’s property caused by the dog. This includes, but is not limited to: Real Estate, Personal Property, Vehicles, Yard, Fence.
4.5 Guardian acknowledges and accepts all responsibility for any bodily injury caused by the dog to any person while in Guardian’s care. This includes but is not limited to: (i) persons living in the home, (ii) visitors, (iii) or anyone or any other animal the dog may come into contact with. Breeder/Owner is not responsible for any such injury caused by the dog, while the Dog is under Guardian’s care.
Section 5. Whelping and Raising Puppies
5.1 The Pregnant Dog will be brought to Breeder’s home a few days before the estimated due date.
5.2 Whelping will be done at the Breeder's home.
5.3 The Puppies and Mother will remain at Breeder’s home until puppies have reached an age of 5 to 6 weeks. After this time the Mother will return to the Guardian home.
5.5 During the whelping period, Guardians are welcome to come visit the Mother at any arranged and agreed upon time with the Breeder.
Section 6. Illness, Injury, and/or Death of Dog while under Guardian’s care
6.1 Guardian must seek immediate and appropriate care if Dog is injured or becomes ill.
6.2 Guardian is to notify Breeder if Dog needs serious medical care and keep lines of communication open to keep Breeder updated.
6.3 If the Dog dies in Guardian’s care, before termination of the contract, no action will be taken by Breeder, unless in case of extreme negligence, or willful killing, or hurting of the Dog by Guardian.
Section 7. Care of Dog by Guardian
7.1 Guardian must contain and supervise the Dog in a responsible manner and in a safe environment.
7.2 Guardian must not leave the Dog alone in a vehicle that can get too hot or too cold.
7.3 Guardian must protect the Dog from toxic or poisonous materials.
Section 8. Indemnity and Release
8.1 If any action or failure to act on the part of Guardian shall result in any claim, suit, loss, damage, injury, death, or liability, Guardian agrees to defend, indemnify, and hold Breeder/Owner harmless and to pay all of Breeder/Owner’s costs and expenses, including reasonable legal fees, any amount paid in settlement and any award or judgment with respect thereto.
8.2 Buyer releases Seller from all liability, costs or damages caused by the Dog after placement with Seller, including but not limited to damage to or destruction of property, and injury to any person.
Section 9. Limitation of Action
9.1 Any action or claim brought by Guardian against Breeder/Owner for breach of this Agreement or for loss due to negligence must be brought within one (1) year of the date such claim or loss occurs.
Section 10. Entire Agreement
10.1 This Agreement represents the entire agreement between the parties. Breeder/Owner and Guardian have made no other agreements, promises, representations or warranties, express or implied, unless specifically stated in this Agreement.
I acknowledge that this is a legal and binding contract and have reviewed and agreed to the terms listed above. This contract applies only to the original Guardian and is NOT transferable.
