Section 1. Deposit, Payment of Purchase Price, Fees
1.1 Payment of the balance may be made by Cash, Venmo, Zelle, or Cashier’s Check. The deposit is non-refundable and will be applied to the purchase price of the dog. The remainder of puppy/dog price will need to be paid in full before puppies are released to their new homes.
1.2 All shipping expenses are at the buyer’s expense.
1.3 The Buyer acknowledges and agrees that the Buyer will forfeit the deposit and any rights to the Dog if:
(1) the Buyer fails to complete the purchase of the Dog for any reason, or
(2) the Buyer fails to pay the balance of the Purchase Price in full prior to the agreed delivery date and before the dog is handed over to the Buyer. The purchase price of the dog can be paid at any time prior to delivery but must be paid before the dog can be handed over.
In either event, the Seller shall be free to sell the Dog to another party.
1.4 In the event that the Dog is not available due to sickness, death, or any other circumstance owing to the fault of the Seller, the Buyer’s deposit will, at the Buyer’s option, be either (i) refunded, or (ii) transferred to the next litter of puppies.
1.5 Boarding Fee: Buyer agrees to pick up or have the dog delivered within 7-10 days from the day the deposit is placed, provided the dog is already 8 weeks or older. A boarding fee of $45 per day will be charged for each day the Dog is boarded by the Seller (a) past the day the deposit it placed and (b) the dog is 8 weeks old.
Section 2. Damage to Buyer’s property and/or bodily injury
2.1 The Buyer acknowledges and accepts that they are solely responsible to Potty Train the dog for their home and their own personal environment. No guarantee is given or implied in any manner that the puppy will not have accidents in the Buyer’s home. Although foundational potty training has been provided using a doggy door and kennel training, the Buyer acknowledges that they are solely responsible to provide potty training in their home after ownership has been transferred. The Seller is not responsible for dog Urine and/or feces in the home.
2.2 The Buyer acknowledges and accepts that they are solely responsible to provide crate training in their home, if they so choose.
2.3 The Buyer acknowledges and accepts the risk of possible damage by bringing an animal into the home and holds the Seller blameless for any and all such damage.
2.4 The Buyer acknowledges and accepts that the Buyer is solely responsible for any possible damage caused by the dog and that the Seller is not responsible for any damage to the Buyer’s property caused by the dog after ownership has been transferred to the Buyer. This includes, but is not limited to: Real Estate, Personal Property, Vehicles, Yard, Fence.
2.5 Although great care is taken to breed sweet and loving puppies and to provide them with love and interaction with adults and children, the Buyer acknowledges and accepts all responsibility for any bodily injury caused by the dog to any person after ownership has been transferred to the Buyer. This includes but is not limited to: (i) persons living in the home, (ii) visitors, (iii) or anyone or any other animal the dog may come into contact with. The Seller is not responsible for any such injury caused by the dog.
2.6 Stay and Train: A fee of $75 per day will be charged for stay and train (if this option is selected). This will provide additional training and individual attention to your purchased puppy, from the time of purchase (but not before the puppy is 8 weeks old and able to leave its mother) to the date of delivery. Training entails bringing the puppy into the home and focusing on crate and potty training and basic commands. Though this additional training will give the puppy a great foundation for in-home living and a head start for the buyer, no guarantees are given about how they will adapt to their new home environment once ownership is transferred. The Buyer will still be responsible for continuing the training in their own home. All clauses in this agreement still apply, including, but not limited to: paragraph 2.1, 2.2, 2.3, 2.4, 2.5.
Section 3. Transfer of Ownership and Registration
3.1 Upon payment in full of the Purchase Price, (and shipping if necessary) the Seller (at the Seller’s sole cost) shall promptly take all actions required to officially transfer ownership and registration (if any) of the Dog to the Buyer.
Section 4. Seller’s Representations and Warranties
4.1 The Seller represents and warrants to the Buyer that: The puppy will come with first round of shots, multiple deworming’s, and health record and that the Dog is in good health and free of communicable diseases at the time of this sale.
4.2 The Seller encourages the Buyer to have the Dog examined by a licensed veterinarian within 72 hours after delivery of dog, at Buyer’s sole expense. Failure by the Buyer to have the Dog examined within the 72 hour period will nullify and void this warranty.
4.3 If there is a problem that cannot be rectified, the Buyer may return the puppy to the Seller, subject to the following conditions (i) at the Buyer’s sole expense, (ii) on the day following the vet exam, (iii) along with a veterinarian’s statement stating the problem, the Buyer will receive a full refund of the purchase price of the puppy less any shipping fees, and other expenses.
4.5 Exclusion - This does not include the presence of parasites and/or organisms and also does not apply to a health problem resulting from an injury or accident due to Buyer’s negligence.
4.6 All medical expenses are the sole responsibility of the Buyer. If the Buyer chooses to keep the puppy, no replacement will be given, and all medical costs and treatment are the sole responsibility of the Buyer. Medical expenses are not the responsibility of the Seller.
4.7 The Seller provides a 1 Year Hip Guarantee against genetic moderate or severe hip dysplasia, and retinal eye disease.
4.8 The hip dysplasia and retinal eye disease guarantee is subject to the following conditions: Because 60% of all canine hip dysplasia is related to poor nutrition, we require that your precious puppy continue with Exclusive Signature for the first 12 months of his/her life in order to qualify for this 1 year health guarantee. Remember, an ounce of prevention is worth a pound of cure! If you continue feeding your puppy Exclusive Signature for the first 12 months, this dog is guaranteed against genetic moderate or severe hip dysplasia, and retinal eye disease until it is 12 months of age. OFA or Penn hip are the sole and only judges in determining hip dysplasia. A CERF certified veterinarian must confirm any hereditary eye defects. Nutrition & Food: Our puppies begin on a holistic dogfood called Exclusive Signature when starting dry food because of the powerful antioxidants which will eliminate free radicals and boosts the immune system. Creating a preventative against skin and coat problems, various forms of cancer, heart issues, arthritis, cataracts, tumors, digestive problems, allergies, and hip dysplasia. We believe it is crucial for your puppy to continue taking Exclusive Signature through their lifetime. Please note: providing a higher nutritious valued food, helps to prevent fast growth, fewer bone problems, fewer vet bills, and promotes longer life.
4.9 To take advantage of this offer, you will need to provide proof of purchases of the products to Seller.
4.10 At any time your pet is removed from Exclusive Signature before the age of 12 months, the 1 Year Hip Guarantee against genetic moderate or severe hip dysplasia, and retinal eye disease becomes void without exceptions.
4.11 The Seller does not guarantee against common and easily treatable parasites, worms, viral illnesses, infections, and minor, easily treatable conditions. Seller is not responsible for any puppy death due to dehydration, or any other illness that could have been prevented or treated by the Buyer. Although the puppy has been treated against Parvo, Distemper, Adenovirus, Para influenza, giardia, and coccidia, no guarantee is given against these viruses and/or parasites due to their unpredictable nature.
4.12 No warranties or guarantees, expressed or implied, are made under this contract, except as stated.
Section 5. Buyer’s Representations
5.1 The Dog will reside with Buyer as companion pet to the Buyer and the Buyer’s family.
5.2 The Buyer will provide the Dog with nutritious food and necessary veterinary care, including de-worming, heart worm prevention and regular vaccinations. The puppy shall be socialized properly after all immunizations are given.
5.3 The Buyer is not acting as an agent for any other person or business in the purchase of the Dog.
5.4 First Right of Recovery: If the Buyer is unable to care for or chooses to change his or her mind about caring for the puppy purchased, Canterbury Canines retains the right to recovery of the puppy at the Buyer’s expense. The Buyer must notify Canterbury Canines as to the change in circumstances and given first right of resuming ownership.
5.5 If the Buyer chooses to return the dog according to paragraph 5.4 above, the Buyer agrees that no refund will be given and no reimbursement of any expenses.
5.6 The dog must never be sold to a pet store, broker, puppy mill, or surrendered to a shelter, or sold out right to anyone. Breeder must be notified immediately of any problems that arise or if buyer cannot care for the dog anymore.
Section 6. Indemnity and Release
6.1 If any action or failure to act on the part of Buyer shall result in any claim, suit, loss, damage, injury, death, or liability, Buyer agrees to defend, indemnify, and hold Seller harmless and to pay all of Seller’s costs and expenses, including reasonable legal fees, any amount paid in settlement and any award or judgment with respect thereto.
6.2 Buyer releases Seller from all liability, costs or damages caused by the Dog after placement with Seller, including but not limited to damage to or destruction of property, and injury to any person.
Section 7. Limitation of Action
7.1 Any action or claim brought by Buyer against Seller for breach of this Agreement or for loss due to negligence must be brought within one (1) year of the date such claim or loss occurs.
Section 8. Entire Agreement
8.1 This Agreement represents the entire agreement between the parties. Seller and Buyer have made no other agreements, promises, representations or warranties, express or implied, unless specifically stated in this Agreement.
I acknowledge that this is a legal and binding contract and have reviewed and agree to the terms listed above. This contract applies only to the original Buyer and is NOT transferable.
